Terms of Services

Last Updated: October 15, 2026

1. Introduction

Welcome to ibiks.dev, the professional portfolio website of Olawale Ibikunle. These Terms of Service govern your access to and use of this website and the services offered through it.

By accessing this website or engaging my services, you agree to these terms. If you do not agree, please discontinue using the website.

2. Services Offered

I provide digital design and development services, including:

  • Web design and development.

  • Mobile application development.

  • UI/UX design.

  • eCommerce website and online store development.

  • Search engine optimization (SEO).

  • Website maintenance, optimization, and related digital services.

The scope, deliverables, pricing, and timeline for each project will be agreed upon separately before work begins.

3. Project Agreements and Payments

Each project may require a separate proposal, quotation, invoice, or written agreement outlining the scope of work, deliverables, payment schedule, and estimated completion date.

Unless otherwise agreed in writing, my standard payment terms are:

  • 70% upfront: Required before work begins.

  • 30% final payment: Due upon completion, before final delivery or handover.

Additional features, revisions outside the agreed scope, or new requirements may incur additional charges. Any such costs will be communicated and agreed upon before the extra work begins.

Delays in payments, content delivery, feedback, or approvals may affect the project timeline.

4. Client Responsibilities

Clients agree to:

  • Provide accurate information and the materials needed for the project.

  • Supply content, images, branding assets, and access credentials where required.

  • Review designs and deliverables and provide feedback within reasonable timeframes.

  • Ensure that materials supplied for the project can legally be used.

  • Make payments according to the agreed terms.

I am not responsible for delays caused by missing information, delayed approvals, or circumstances outside my reasonable control.

5. Revisions and Changes

The number of revisions included in a project will be specified in the relevant proposal or agreement.

Requests that significantly change the original scope, design direction, or functionality may be treated as additional work and charged separately.

I will communicate any significant changes to the cost or timeline before proceeding.

6. Intellectual Property

Unless otherwise agreed in writing, ownership of custom work created specifically for a client will transfer to the client after full payment has been received.

Until full payment is made, the work remains subject to the agreed payment and ownership terms.

Third-party software, plugins, fonts, stock images, themes, frameworks, and other licensed materials remain subject to their respective licence conditions.

I retain ownership of my pre-existing tools, reusable code, development methods, and general know-how that may be used during a project.

7. Portfolio and Project Display

Unless otherwise agreed in writing, I may display completed projects, screenshots, and descriptions of my work in my portfolio, on ibiks.dev, and in professional promotional materials.

Confidential information, private client data, and materials subject to confidentiality restrictions will not be disclosed without appropriate authorisation.

Clients who require confidentiality may request a written agreement before work begins.

8. Website Maintenance and Support

Ongoing maintenance, technical support, updates, backups, security monitoring, and content changes are not automatically included in a development project unless specified in the relevant agreement.

Where maintenance or support is provided, its scope, duration, fees, and response expectations will be agreed upon separately.

Clients are responsible for maintaining any hosting, domain, software, or third-party subscriptions assigned to them unless otherwise agreed.

9. Third-Party Services

Projects may rely on third-party platforms and services, including hosting providers, payment gateways, APIs, plugins, themes, and external software.

I do not control the availability, pricing, policies, or future functionality of these third-party services. Additional work may be required if a third-party provider changes or discontinues a service.

Third-party fees and subscriptions are the client’s responsibility unless explicitly included in the project agreement.

10. SEO and Performance Disclaimer

I use appropriate practices to improve website usability, technical performance, and search engine optimisation where these services are included.

However, I cannot guarantee specific search rankings, traffic levels, sales, conversion rates, or revenue because these outcomes depend on factors beyond my control.

Similarly, website performance may be affected by hosting, third-party scripts, plugins, network conditions, and other external factors.

11. Cancellations and Refunds

If a client cancels a project, payment for work already completed and any non-refundable expenses incurred will be considered when determining the amount due.

Any refund of unused payments will be assessed in accordance with the project agreement and applicable law.

Deposits and advance payments are not automatically refundable in every circumstance. Any cancellation charges or refund conditions must comply with applicable consumer protection laws and the terms agreed for the project.

12. Limitation of Liability

To the extent permitted by applicable law, I will not be liable for indirect or consequential losses, including lost profits, lost business opportunities, or losses caused by third-party service interruptions.

Nothing in these terms excludes or limits liability where doing so would be unlawful, including liability that cannot legally be excluded under applicable law.

Clients remain responsible for reviewing their websites, business processes, and legal obligations before launching or using a digital product.

13. Confidentiality

Both parties should take reasonable steps to protect confidential information shared during a project.

Confidential information should only be used for the purposes for which it was provided and should not be disclosed to unauthorised parties, except where disclosure is legally required or otherwise authorised.

Any additional confidentiality requirements should be documented in writing.

14. Acceptable Use

You agree not to use this website to engage in unlawful activities, attempt unauthorised access, distribute malicious software, interfere with website operations, or misuse content and intellectual property belonging to others.

I reserve the right to take reasonable steps to protect the website and its users against misuse.

15. Changes to These Terms

I may update these Terms of Service from time to time to reflect changes in my services, website operations, or legal requirements.

Updates will be published on this page with a revised date. Continued use of the website after changes take effect constitutes acceptance where permitted by applicable law.

16. Governing Law

These terms are subject to the laws applicable to the relevant agreement and any mandatory legal requirements that apply to the parties.

Where necessary, the governing law and dispute resolution arrangements for a specific project will be stated in the applicable project agreement.
